Terms of Service

By accessing this website, using the DanDigital client portal, viewing a demo, requesting a proposal, purchasing services, or otherwise engaging with DanDigital, you agree to these policies. If you do not agree, you should not use the website or purchase services.

DanDigital provides website design, development, managed hosting, client portal access, support, digital automation, related technical services, and any additional services clearly described in writing. The exact service package, pricing, deliverables, and timelines may vary by proposal, invoice, subscription, support arrangement, or onboarding agreement.

These policies apply together with any written quote, proposal, project scope, invoice, portal terms, onboarding confirmation, or client-specific agreement issued by DanDigital. Where a written client-specific agreement expressly conflicts with this page, that written agreement will apply to the extent of the conflict.

These terms are intended to set practical rules for a digital service business. They are not decorative filler.

Services, Quotes & Scope

1. Quotes, demos, and proposals

Website demos, mockups, concept pages, audit-style previews, and proposal material are provided for evaluation purposes. Unless otherwise stated in writing, a demo does not itself create a binding delivery obligation until payment, onboarding, or written acceptance has been completed.

2. Scope of work

Project scope includes only the services, pages, features, integrations, revisions, and support items expressly included in the relevant package or written agreement. Anything outside agreed scope may require additional fees, revised timelines, or a new statement of work.

3. Client responsibilities

Clients are responsible for providing accurate information, approvals, branding assets, access credentials, lawful content, and timely feedback where required. Delays in approvals, missing content, changing requirements, or late responses may delay delivery and may affect project timelines.

4. Third-party services

DanDigital may rely on third-party services such as hosting providers, email delivery providers, payment processors, analytics tools, cloud infrastructure, authentication services, and content delivery systems. Availability, pricing, features, and uptime of those services are outside DanDigital’s direct control.

5. Support and ongoing updates

Ongoing support, edits, maintenance, content updates, monitoring, and technical assistance are provided only where included in an active plan, invoice, subscription, or written support arrangement. Ad hoc requests outside those arrangements may be billed separately.

6. Intellectual property

Unless otherwise agreed in writing, DanDigital retains ownership of its pre-existing tools, systems, templates, reusable code, internal frameworks, automation flows, internal UI patterns, operational logic, and business processes. Clients retain ownership of their pre-existing content, trademarks, logos, and materials supplied by them.

Subject to full payment of the applicable fees, clients receive the rights reasonably necessary to use the delivered website and agreed deliverables for their business purpose. DanDigital may retain the right to reuse non-confidential know-how, generic design patterns, internal systems, and platform components that are not uniquely owned by the client.

Billing, Refunds & Cancellations

1. Fees and payment

Fees may include setup fees, project fees, monthly hosting or maintenance charges, support charges, subscription charges, domain or third-party pass-through costs, and other charges clearly disclosed before purchase. Payment terms may appear in a quote, invoice, payment page, checkout flow, or client portal.

2. Invoices and due dates

Invoices are payable on the due date stated on the invoice unless another written arrangement applies. DanDigital may suspend work, pause delivery, disable certain portal features, withhold launch, or suspend hosting-related services where invoices remain unpaid.

3. Setup fees and custom work

Because digital build work, setup work, planning, implementation, onboarding, and customization involve time and technical labour, setup fees, deposits, and project-stage payments are generally non-refundable once work has started, except where a refund is required by law or expressly agreed by DanDigital in writing.

4. Monthly services and cancellation

For recurring services such as managed hosting, maintenance, support, or subscriptions, cancellation takes effect in line with the billing arrangement communicated at purchase. Unless a different period is stated in writing, cancellation will not usually reverse charges already incurred for the current billing period.

5. Refund discretion

Where DanDigital grants a refund in its discretion, the refund may be full, partial, credited, or refused based on work completed, resources consumed, account usage, third-party charges already incurred, and whether the service involved custom or time-based work.

6. Failed or reversed payments

If a payment fails, is reversed, is charged back, or is disputed without valid cause, DanDigital may suspend services, restrict access, recover associated costs, or require payment by an alternative method before continuing services.

Privacy Policy

1. Information we may collect

DanDigital may collect personal and business information including names, email addresses, phone numbers, company details, billing details, website content, technical usage data, support messages, account records, login activity, and any information voluntarily submitted through forms, demos, onboarding, support requests, checkout flows, invoices, or portal interactions.

2. Why we collect it

We use personal information to respond to enquiries, prepare demos or proposals, onboard clients, provide website and portal services, manage accounts, send service communications, process payments, prevent misuse, maintain security, improve service quality, keep business records, and comply with legal obligations.

3. No sale of personal information

DanDigital does not sell personal information. We may share information with service providers or contractors only where reasonably necessary to run the business, for example hosting, infrastructure, payment processing, analytics, authentication, email delivery, backups, customer support, and security monitoring.

4. Service communications

We may send non-marketing service communications such as onboarding emails, password reset emails, billing notices, support replies, account alerts, security notifications, and service updates. These communications are part of operating the service and are not the same thing as optional marketing messages.

5. Security

DanDigital takes reasonable technical and organisational steps to protect personal information. However, no website, portal, server, email system, cloud platform, or transmission method can be guaranteed to be perfectly secure.

6. Retention

We keep information only for as long as reasonably necessary for the purposes for which it was collected, for legal compliance, for recordkeeping, for security, for dispute handling, or for legitimate business continuity needs.

Cookies & Tracking

This website and related systems may use cookies, local storage, pixels, session mechanisms, and similar technologies to maintain sign-in state, remember preferences, measure traffic, protect accounts, improve performance, and understand how users interact with the website, client portal, demos, or email communications.

Some tracking may also be used in service emails or outreach workflows to determine whether an email was opened, whether a link was clicked, or whether a workflow completed successfully. This helps DanDigital operate campaigns, diagnose delivery issues, and improve service performance.

You can usually manage cookies through your browser settings, but disabling them may affect login, portal functionality, analytics accuracy, saved preferences, or other parts of the service.

POPIA & Data Rights

Where applicable, DanDigital aims to process personal information lawfully and reasonably in line with South African data protection principles, including POPIA. Personal information is collected for specific business purposes and should not be used in a way that is incompatible with those purposes unless permitted by law.

Depending on applicable law and subject to legal exceptions, you may request access to personal information held about you, ask for correction of inaccurate information, object to certain processing, or ask for deletion where appropriate.

Internal compliance reminder: private bodies in South Africa are required to register an Information Officer with the Information Regulator.

Acceptable Use

You may not use the website, portal, demo system, support channels, or any DanDigital service to:

  • break the law or promote unlawful conduct;
  • submit misleading, infringing, abusive, fraudulent, or malicious content;
  • attempt unauthorised access to systems, accounts, or data;
  • interfere with platform security, performance, or availability;
  • upload malware, spam, deceptive content, or harmful scripts;
  • use the service to infringe intellectual property or privacy rights; or
  • abuse demos, outreach systems, or account flows in a way that harms DanDigital, its clients, or third parties.

DanDigital may suspend, restrict, or terminate access where misuse, non-payment, fraud, abuse, or security risk is reasonably suspected.

Disclaimers & Liability

1. Website and service availability

DanDigital makes reasonable efforts to keep the website, portal, demos, and services available and accurate, but does not guarantee uninterrupted access, perfect accuracy, error-free operation, or compatibility with every device, browser, integration, platform, or business use case.

2. No blanket guarantees

Unless expressly stated in writing, DanDigital does not guarantee rankings, leads, conversions, revenue increases, uninterrupted uptime from third-party providers, or any specific commercial outcome from a website, campaign, demo, or system.

3. Limitation of liability

To the fullest extent permitted by law, DanDigital will not be liable for indirect, incidental, consequential, punitive, or special damages, including lost profits, lost data, lost opportunities, downtime losses, or reputational harm arising from use of the website or services.

To the fullest extent permitted by law, DanDigital’s total aggregate liability in relation to a claim connected to paid services will not exceed the amount actually paid by the client to DanDigital for the specific service giving rise to that claim during the three months immediately preceding the event giving rise to the claim.

4. Legal limits apply

Nothing on this page excludes or limits liability where such exclusion or limitation is not permitted under applicable law.
